Privacy Policy

This Privacy Policy explains how ProsPal, Inc. (“ProsPal,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information when you access or use the ProsPal website, platform, and related services (the “Platform”). This Privacy Policy is incorporated by reference into our Terms of Use. By using the Platform, you acknowledge that you have read and understood this Privacy Policy.
This Policy applies to both Clients (individuals who request or search for home services) and Providers (independent third parties who receive service leads). Capitalized terms not defined here have the meanings given in our Terms of Use.
1. Information We Collect
We collect the following categories of personal information:
**Information you provide directly. **When you submit a service request, register an account, or communicate with us, we may collect your name, email address, telephone number, postal or service address, the type of service requested, and details about the job (such as scheduling preferences, photos, or descriptions you choose to share).
**Provider business information. **If you register as a Provider, we collect business contact details, service categories, service area, and information relevant to lead matching. Providers may also submit licensing, insurance, or similar documentation.
**Payment information. **Payments are processed by third-party payment processors. We do not store full payment card numbers on our own systems; our processors handle that information under their own security and privacy practices.
**Communications. **We may retain records of messages, call notes, and other communications exchanged through or facilitated by the Platform, including for quality, dispute-resolution, and compliance purposes.
**Automatically collected information. **When you use the Platform, we automatically collect certain technical data such as IP address, device and browser type, pages viewed, referring URLs, and similar usage data through cookies and comparable technologies.
**Third-party data. **Our matching process may incorporate third-party data such as public business reviews, ratings, and geographic data. We do not verify the accuracy of such third-party data.
2. How We Use Your Information
We use personal information to:
- Operate the Platform and provide our services, including matching Clients with Providers;
- Facilitate the delivery of service leads to Providers and communications between Users;
- Send transactional and service-related notifications by email, SMS, and messaging channels (such as WhatsApp), where you have provided any consent required by law;
- Process payments and manage billing;
- Detect, investigate, and prevent fraud, abuse, security incidents, and violations of our Terms of Use;
- Comply with legal obligations and enforce our agreements;
- Analyze and improve the Platform and develop new features.
3. How We Share Your Information
We are a technology platform that connects Clients with independent Providers. To operate this service, we share information as follows:
**With Providers. **When a Client submits a service request, relevant lead information — which may include the Client’s name, contact details, location, and service request details — may be made available to one or more Providers so they can respond. Providers are contractually required to use Client information solely to respond to the applicable service request and to comply with all applicable privacy laws. Providers are prohibited from using Client information for unrelated marketing or from selling or repurposing it.
**With service providers and vendors. **We share information with third parties that perform services on our behalf, such as hosting, email delivery, messaging, mapping and geolocation, analytics, and payment processing. These vendors are permitted to use personal information only as needed to perform services for us.
**For legal and safety reasons. **We may disclose information where we believe it is reasonably necessary to comply with law, enforce our Terms, respond to lawful requests, or protect the rights, property, or safety of ProsPal, our Users, or others.
**In a business transfer. **If we are involved in a merger, acquisition, financing, or sale of assets, personal information may be transferred as part of that transaction, subject to reasonable notice where required by law.
We do not sell your personal information for money. Certain data-sharing practices for advertising or analytics may be considered a “sale” or “sharing” under California law; see Section 7 for your rights and how to opt out.
4. Cookies and Tracking Technologies
We and our service providers use cookies, pixels, and similar technologies to operate the Platform, remember preferences, measure performance, and understand usage. You can control cookies through your browser settings; disabling some cookies may affect Platform functionality. Where required by law, we present a cookie consent mechanism that lets you accept or decline non-essential cookies.
5. Data Retention
We retain personal information for as long as necessary to provide the Platform, comply with our legal obligations, resolve disputes, and enforce our agreements. Retention periods vary depending on the type of information and the purpose for which it was collected. When information is no longer needed, we take reasonable steps to delete or de-identify it.
6. Data Security
We maintain reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.
7. Your Privacy Rights
7.1 California Residents (CCPA/CPRA)
If you are a California resident, you have the right to: (a) know the categories and specific pieces of personal information we have collected about you; (b) request deletion of personal information we have collected, subject to legal exceptions; (c) request correction of inaccurate personal information; and (d) opt out of any “sale” or “sharing” of personal information and limit the use of sensitive personal information, to the extent applicable. We will not discriminate against you for exercising these rights.
To exercise these rights, contact us at legal@prospal.ai or through our contact form. We will verify your request before fulfilling it and respond within the timeframes required by law. You may use an authorized agent to submit a request on your behalf, subject to verification.
7.2 Other U.S. State Privacy Rights
Residents of certain other U.S. states may have similar rights to access, correct, delete, or port their personal information, and to opt out of targeted advertising or the sale of personal information. 7.3 How to Exercise Your Rights
You may submit privacy requests by emailing legal@prospal.ai. For your protection, we may need to verify your identity before processing certain requests. If we decline a request, we will explain why, subject to legal limitations.
8. Marketing and Communications Choices
With your consent where required, we may send you marketing communications. You can opt out of marketing emails by following the unsubscribe instructions in those emails, and you can opt out of marketing text or messaging communications by replying STOP or using the opt-out method provided in the message. Even if you opt out of marketing messages, we may still send you non-promotional, transactional, or service-related communications.
9. SMS and Messaging Consent
If you provide your telephone number and agree to receive SMS or messaging notifications (including via WhatsApp), you consent to receive automated service-related and, where you have agreed, promotional messages from or on behalf of ProsPal. Message and data rates may apply. Consent is not a condition of purchase. You may opt out at any time by replying STOP. For help, reply HELP or contact legal@prospal.ai.
10. Children’s Privacy
The Platform is not directed to children under 18, and we do not knowingly collect personal information from children under 18. If we learn that we have collected personal information from a child under 18, we will take reasonable steps to delete it. If you believe a child has provided us with personal information, contact us at legal@prospal.ai.
11. Third-Party Links and Services
The Platform may contain links to third-party websites or services that we do not own or control. This Privacy Policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party services you use.
12. International Users
The Platform is intended for users located in the United States. If you access the Platform from outside the United States, you understand that your information will be processed in the United States, where data protection laws may differ from those in your jurisdiction.
13. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we make material changes, we will post the updated Policy on the Platform and update the Effective Date above, and, where required by law, provide additional notice. Your continued use of the Platform after the changes take effect constitutes your acceptance of the revised Policy.
